Huh??????
By Meridith Doane, News Staff Writer Friday, September 22, 2006 MOUNT VERNON — Everyone wants their 15 minutes of fame, but Mount Vernon resident Rolly Devore didn’t think he’d find it on a television court program over a payment dispute involving a song he wrote. In July, Devore appeared on the program “Christina’s Court” as a witness for Harold Logsdon. Logsdon wanted to use a song Devore had written, “What If,” in the production of a music video. In the video, Lisa Marie Presley would appear as a child singing in a music video reminiscing of her father, Elvis. Devore thought it was a great idea and agreed to the use of his song, and Logsdon paid $675 to get the production started. The recording company, Schrodingers Cat Productions Inc., signed a contract with Devore and Logsdon, and agreed to produce the video, although it never did. The company withdrew from the contract, and did not reimburse Logsdson any of his money. Logsdon wanted justice and hoped to retrieve his $675.00 in court, asking Devore to be his witness to the contract. Devore was flown to Texas to appear on the nationally publicized TV program, where it would be decided whether the $675 was legally owed to Logsdon. Devore brought as evidence his Master Recording Usage License Contract, which was signed and dated by the production company. The judgment was ruled in favor of Logsdon. Devore, however, said he was bothered by the outcome because although the case was actually in favor of Logsdon, and the production company agreed to pay, it never did. “So in a way, though Logdson won the case, he actually lost because the TV court never enforced the payment by Schrodinger as was ruled,” Devore said, adding that he couldn’t understand how the court could get by with not enforcing payment. So how does Devore feel about the term “justice is always served?” “The court shows on television are just a means to making money for themselves,” said Devore. “The money awarded by the court to the plaintiff was never paid, and they didn’t seem to care about whether or not Logsdon actually received the money that was ordered to be paid to him.” Devore won’t let the experience stop him from continuing his songwriting, however, and still composes many songs. He has written a song titled “Christina,” an account of his time in Texas while there for the show. Three of his songs have since been played at a “Battle of the Bands” competition. Logsdon may one day find someone trustworthy enough to produce Devore’s music video, but he will definitely not be doing business with Schrodinger again. And Devore’s advice is to not use publicized court TV as a means to settling a dispute. “It just doesn’t pay off,” he said. "I paint my own reality. The only thing I know is that I paint because I need to, and I paint whatever passes through my head without any other consideration. " ~ FRIDA KAHLO |
